Terms of use

These terms are the contract between you and the party responsible for the game Asaria. They apply to the game on PC and mobile, to the launcher, to this website, to the forum and to support. Please also read the Privacy policy, which is part of them.

1. Who we are

The game Asaria is published by David Kevin Nogueira da Silva, Neuraframe (empresa individual, Suíça), Rue des Fleurettes 15, CH-1400 Yverdon-les-Bains. Contact: privacidade@playasaria.com.

2. Acceptance

By creating an account, you declare that you have read and accepted these terms and the Privacy policy. When they change in an important way, the new version will be published with a new date and the game will ask for a new acceptance at your next sign-in. If you do not accept, you can delete your account at any time.

3. Minimum age

You must be at least 13 years old to create an account. Between 13 and 18, you need the authorization of a parent or guardian, who supervises the use of the game and is responsible for it. An account belonging to someone under 13 will be closed.

4. Your account

• The account is personal. You are responsible for what is done with it: keep the password to yourself and use an email address only you read.
• Nobody on the team will ever ask for your password, under any circumstances — not by email, not in chat, not on the forum.
• You may have more than one account, as long as each one respects these terms.
• Tell support if you think someone has entered your account.

5. Rules of conduct

These rules apply to chat, private messages, the forum, character names, nicknames and any other content you publish. It is forbidden to:

• harass, intimidate, threaten or humiliate other players;
• publish hate speech or discrimination (origin, colour, religion, gender, sexual orientation, disability or any other);
• publish sexual content — and, with zero tolerance, any content that sexualizes minors or any approach to minors with that intent;
• publish extremely violent or illegal content, or content that encourages self-harm;
• disclose another person's personal data (name, address, phone number, photos, documents);
• send spam, advertising, scams or phishing links, or ask another player for their password, code or email;
• impersonate the game team or another player;
• cheat: third-party programs, bots, macros that play in your place, exploiting bugs, modifying the game or its network traffic;
• sell or buy accounts, characters, items or game currencies for real money outside the official means;
• choose an offensive or misleading character name or nickname, or one that imitates the team.

6. Reporting, blocking and moderation

In the game, you can report a message or a player and block a player, who can then no longer talk to you. A reported message and the recent context of the conversation are kept for the moderation team, which reviews the reports. On the forum and in support, the team can also moderate published content. Moderation can remove content, change a name or a nickname and apply sanctions.

7. Sanctions and appeal

Depending on severity and repetition, the team can apply: a warning, a chat mute, content removal, a mandatory name change, a temporary suspension or a ban of the account — and, in case of payment fraud, the measures described in the purchase rules. Serious cases (content involving minors, threats) may be reported to the authorities.

You can contest a sanction through support or at privacidade@playasaria.com. The appeal is reviewed by a person on the team.

8. Game items and currencies

Crystals, coins, items, characters and any other game content are a personal licence to use, not transferable outside the game and revocable under these terms. They have no monetary value, are not money, are not refundable in money (unless the law requires it) and cannot be exchanged for real money.

9. Purchases

Real-money purchases follow the Purchase and refund rules, which you accept with each purchase. They describe delivery, the right of withdrawal, chargebacks and fraud prevention.

10. Beta

The game is in beta: it still has bugs and changes often. During the beta, characters and progress may be reset, especially before the official launch; the account is kept. We announce each reset beforehand in the game or on the forum.

11. Availability and changes to the game

The game is offered as is, online only. We do our best to keep it available, but maintenance, outages and changes to content, balance or rules may occur. We may shut the game down; in that case, we will give reasonable notice.

12. Closing the account

• By you, at any time: on the Delete account page. The account is closed immediately and erased 14 days later, as described in the Privacy policy.
• By us, in case of a serious or repeated breach of these terms, of fraud, or when the law requires it.

13. Liability

We are liable for damage caused by our fault, within the limits of the law. We are not liable for content published by other players, nor for losses caused by third parties, by a lent account or by a disclosed password. Nothing in these terms limits the rights that the law of your country grants consumers and that cannot be waived by contract.

14. Governing law and jurisdiction

These terms are governed by Swiss law, and the courts of the controller's seat in Switzerland have jurisdiction, subject to the mandatory rules of the country where you live: a consumer in Brazil keeps the rights of the Consumer Protection Code and the courts of their domicile, and a consumer in the European Union keeps the protection of the law of their country of residence.
